this is santhosh ram from tamilnadu,
i received the notice under sec 143(1) regarding relief u/s 89 , because we were not filed form 10e,
so now this situation how to reply and process for cancellation the demand
please guide me...

From what i understand, the relief under section 89 was available but not given because form 10 e was not filled and therefore demand raised through 143(1) for the relief amount ...............Simply fill and submit form 10 e now and submit rectification request under reprocess the case ...the reli...

The restriction to not file using ITR 1 /ITR 4 for joint property holders or those falling under 7th provisio to 139(1) has been removed following CBDT's press release on 9th January after considering the hardships faced by taxpayers

(Note : - The seventh proviso of section 139(1) covers those individuals - (a) who have deposited more than Rs 1 crore in one or more current accounts in the FY 2019-20, (b) who have spent more than Rs 2 lakh on foreign travel on him/herself or any other person and (c) those who have paid more than Rs 1 lakh as electricity bill in FY 2019-20.)

From what i know , you can very well file your return ITR 1 in this case

...your wife is not a co owner of the property and is not required to file return of income as long as her gross total income is below threshold level
