Hi
Last year, i have to submit ITR-1 but till date not submitted due to arrear bifurcation. Now i am ready to submit 10E and ITR-1. I want to know, ITR-1 form is now submitted under section before due date139(1) or after due date 139(4).

There is a certain due date for filing returns ...obviously once you file after due date , you are late and so you shall use belated section ...department doesn't care for the reason ...

I wanted to know income tax liabilities of husband on below amount received on death of his wife.
At the time of death, wife was working as a government employee.

1. Monthly Pension
2. EPF amount
3. Gratuity
4. Insurance claims received as nominee
5. Bank savings and fixed deposits

2. EPF amount - If served more than 5 continous years , then exempt
3. Gratuity - Legal heir as other sources ( taxable portion)

Return cannot be filed now ...try seeking condonation under section 119(2)(b) ...if Commissioner approves, then file under sectioon 119(2) b with section 139 and it shall get processed ( however genuinity of hardship needs to be established for non filing of tax returns...mere ignorance won't work)
